The Brikama Magistrates’ Court has entered judgment in favour of businessman Ebrima Gaye in a civil case in which he sought to recover D100,000 paid to fellow businessman Salifie Demba to facilitate travel arrangements for another person.
Magistrate K.B. Sambou entered judgment on Monday, 21st September 2026, after the defendant failed to appear in court for the fourth consecutive hearing.
According to the statement of claim, Gaye said he had given D100,000 to Demba to facilitate the travel of another person. However, the intended travel did not take place, and the person who was expected to travel subsequently took Gaye to court.
Gaye therefore sought the recovery of the D100,000, as well as costs associated with the legal proceedings.
The case first came before the court on 10th March 2026. On that occasion, Gaye was absent, while Demba was present.
The court adjourned the matter to 23 March and warned that the case could be struck out for want of diligence if the plaintiff failed to appear at the next hearing.
Gaye subsequently attended the scheduled hearings, while Demba failed to appear.
At Monday’s hearing, the plaintiff was present but the defendant was again absent.
In his ruling, Magistrate Sambou noted that Demba had failed to attend court on four consecutive occasions and that no explanation had been provided for his absence.
The court consequently entered judgment in favour of Gaye.
Magistrate Sambou ordered Demba to pay Gaye D100,000, representing the amount claimed, together with D1,000 in costs and D10,000 in damages, bringing the total award to D111,000.
