State representative Counsel E R Dugayesterday urged Justice Ebrima Jaiteh of Banjul High Court to dismiss the bail application of Amie Bojang, the second accused in the SukutaJabang Traffic light shooting incident.
It could be recalled that Amie Bojang is charged with accessory to murder for allegedly assisting Ousainou Bojang the first accused person to escape punishment.
State Counsel Duga, in her written response to the application filed by the second accused’s lawyer said, “We urge this court to dismiss the application made by counsel because as a matterof fact…. Section 99 of the Criminal Code does not avail. As it’s clear from the section the applicant cannot be granted bail”.
The application filed by counsel for the second accused on the 6 November 2023 was whether the applicant is entitled to bail pending the hearing and determination of the main trial.
“The applicant contended that section 99 of the Criminal Code insinuates that bail is at the discretion of the court, however this section is clear. The discretion of the court to grant bail is not for persons charged with offences that carry punishment of life imprisonment or death. We therefore submit that the Applicant is not entitled to bail due to the punishment attached to the alleged offence she is charged with,” the state counsel pointed out.
The matter was later adjourned to 20th November 2023 for ruling on the eligibility of the second accused for bail.
