Arson case on transfer to High Court

The Kanifing Magistrate Court Thursday transferred the arson case involving Lamin Bangura to High Court for continuation.

appeared before Magistrate Dunn.

Lamin Bangura is charged with a capital offense which is   Arson contrary to section 305 of the criminal code cap 10:01 volume III laws of the Gambia 2009.

Speaking before the presiding Magistrate Dunn of Kanifing Magistrate Court, the prosecutor told the accused charged is capital offense which attracts life in prison with legal notice number three 2009 which provides the establishment of the special criminal division of the High Court.

The prosecutor therefore appealed to the court to transfer the matter to High Court pursuant to section 62 of the CPC and also that the accused shall be reminded in custody pending the hearing of the matter at the High Court.

In response to that, Magistrate Dunn granted the prosecutor’s application saying the matter shall be transferred to the High Court and that the accused shall be arraigned to the High Court and failure to do so the accused shall be discharged from custody.

According to his particulars of offense Lamin Bangura did on 22nd November 2021, at Bakau willfully and unlawfully set fire to a building causing damages to all the properties inside the house, which valued D694,900 (Six hundred and ninety-four thousand nine hundred dalasis) being the properties of Adeline Davies.
