Court denies repeater accused bail

The Kanifing Magistrate Court has on Monday denied Ebrima Fofana a bail based on the ground that it is not his first time of committing such offence.

The accused, Ebrima Fofafna is currently charged with three count of offence which including burglary, stealing and stealing.

Appearing in the Kanifing Magistrate Court before the presiding Magistrate Colley, when the case was called he pleaded not guilty to the charges though the prosecutor did not against granting him bail but the Magistrate say the accused will not be granted a bail because this is not the first time of him committing such crime.

At the court premises the accused yelled saying he has been in remand for too long and has no family to visit him. “I spent almost one year in prison and I am not guilty,” he shouted.

According to his charge sheet, offence number one, Ebrima Fofana did on the 4th January 2021 at Kanifing South around 4am break into the house of Fatou Faal with intent to commit felony.

Offence number two stated that on the same day and at the same place he stole one laptop Toshiba valued at D7,000, one black insignia flat screen TV valued at D29,950 and a Total sum of D36,950.

However, the particulars stated that he did in the year 2015 and 2019 at Kanifing and Brikama with the prior to the commission of the said offense he has been previously convicted of stealing on the 27th of October, 2015 and 31st September, 2020 at sessions held at the Kanifing and Brikama Magistrate Court. The case is adjourned to the 28 December at 12:30 PM for hearing.
