The Court of Appeal Monday adjourned proceedings in the State’s appeal involving Ousainou Bojang and Amie Bojang after Amie requested time to secure new lawyer following the withdrawal of her counsel, L.K. Mboge.
State Counsel A. Gibba appeared for the appellant, while Counsel L.J. Darboe represented the first respondent before a three-member panel comprising Justice N.N. Salla-Wadda, Justice Basiru V.P. Mahoney and Justice Amina Saho-Ceesay.
The court informed the parties that Counsel L.K. Mboge had written to notify the court of his intention to withdraw from representing the second respondent, Amie Bojang.
Asked whether she was aware of the development, Amie Bojang told the court that she became aware of it last week when she received a letter. She added that she had sent her uncle to meet with Counsel Mboge.
When State Counsel Gibba was asked whether he had been served with the withdrawal letter, he replied in the negative. The court then directed that a copy be served on the State.
The court further asked Amie Bojang how long she would need to secure another lawyer. In response, she requested up to next month to obtain legal representation.
The court noted that the matter had been scheduled for Counsel Mboge to reply on points of law arising from his Notice of Preliminary Objection. In that objection, he challenged the competence of the State’s appeal and argued that the Court of Appeal lacked jurisdiction to entertain both the appeal and the State’s motion seeking to regularise its filing.
In view of counsel’s withdrawal and considering that the matter is criminal in nature, the court holds that it is in the interest of justice to grant the second respondent time to obtain legal representation.
The case was subsequently adjourned to 20 October 2026 for mention.
The Court of Appeal urged Amie Bojang to secure legal representation before the next adjourned date.
