Ousman Jarju suspected killers appear in court, case transferred to High Court

Muhammed Jeng and Hardim Njie who were alleged of killing Ousman Jarju, Tuesday, 14th September, appeared before Magistrate Mam Samba Jallow of the Kanifing Magistrate Court.

However, the court without wasting time has transferred the case to the High Court of The Gambia on legal notice number 3 2009.

The three suspects, Muhammed Touray, Muhammed Njie and Hardim Jeng were charged with three counts of offence including felony, robbery, and murder which are capital offence.

Calling the case, police prosecutor in charge of the case, Inspector Barrow made an application to the court for the case to be transferred to the High Court of The Gambia.

“I applied for this matter to be transferred to the special criminal division of the High Court pursuant to section 5 sub section 1 and legal notice number 3 2009 and the accuse persons should be remanded in custody pending the hearing of the transfer of the matter to the High Court, section 208 A,” he told the court

Reading the charge sheet, Count 1 statement of offences stated that Conspiracy to commit felony contrary to section 368 of the criminal code cap 10:01 vol iii laws of the Gambia 2009.

According to the Particulars, Muhammed Touray, Muhammed Njie and Hardim Jeng on or about the 8th  day of September 2021, at Kololi and diverse places  in the Kanifing  Municipality of the Republic of The Gambia, within the jurisdiction of the court, they conspired among themselves to robbed and stabbed Ousman Jarju to death..

Count 2: Robbery with violence contrary to section 273 of the criminal code cap 10:01 Vol iii of the laws of the Gambia 2009.

According to the Particulars of offence, the three accused on same date and places at Kololi used violence to robbed Ousman Jarju by using knife. While the count 3 of their offence stated that murder contrary to section 187 of the criminal code cap 10:01 Vol iii laws of the Gambia 2009. And the particulars as stated that Muhammed Touray, Muhammed Jeng and Hardim Njie on same date, day and places with malice aforethought caused the death of Ousman Jarju by stabbing him with knife.
