First Witness Testifies in Alleged “Indecent Act” Case Against Two Men.

Momodou A. Sanyang, the first prosecution witness (PW1) appeared before Magistrate I. Jallow of Brusubi Magistrates’ Court to testify against two men accused of engaging in “indecent act,” on Tuesday August 5,2025.

Muhammed Krubally and Muhammad Jawo are charged with one count of “indecent practice among males by sucking each other’s penis.”

Giving his testimony, Mr. Sanyang says he is an officer with the Police Intervention Unit (PIU) stationed in Kanifing. The witness said he recognised the accused persons and recalled the incident that took place on 18th May 2025 at Old Yundum.

PW1 stated: “On that fateful day, I was posted at the residence of the Minister of Interior. At around 9:00 p.m, I took permission from my guard commander to patrol the vicinity, which was granted. During the patrol, I saw a boy named Basiru Sarjo standing near a fence, looking into a particular compound with an incomplete building,” he recalled.

He continued: “I hid and observed the boy. As I approached him slowly, he jumped into the compound, and I followed. I then asked him why he jumped into someone’s property. He responded that he was observing some people inside the incomplete building.”

PW1 said when they entered the building they found the second accused, Muhammad Jawo, lying on his back with his underwear removed, while the first accused, Muhammad Krubally, was allegedly sucking his penis.

The witness added: “At that moment, I jumped through the window and instructed Basiru Sarjo to stand at the window and wait for me. I arrested the accused persons before leaving the house. I asked Muhammad Jawo to pick up his boxer shorts, while Muhammad Krubally was wearing a long gown.”

He said he took the accused persons to the guard post and explained the situation to his commander, who instructed him to take them to the Banjulinding Anti-Crime Unit. A driver dropped them off.

“I handed over the accused persons to officers at the Anti-Crime Unit and gave my statement along with the boy, Basiru Sarjo,” PW1 added.

During questioning, police asked the witness to clarify what he had observed.

PW1 responded: “I found the first accused person, Muhammad Krubally, sucking the penis of the second accused person, Muhammad Jawo. The second accused was lying on his back.”

At that stage, Defence Counsel K. Bojang applied for bail, citing Section 24 of the Criminal Procedure Code (CPC), and informed the court that there were sureties ready to stand for the accused persons.

The matter was then adjourned to 7th August 2025 for cross-examination.
