Justice Ministry Says Pa Modou Njie Drug Case Still Active

The Attorney General’s Chambers and the Ministry of Justice have clarified that the criminal case involving former Chief Magistrate Pa Modou Njie is still active and has been formally transferred to the High Court in Banjul.

A statement signed by Solicitor General and Legal Secretary Hussein Thomasi, the Ministry said on Wednesday, said the matter was filed at the High Court on May 28, 2025, days after it was struck out by the Bundung Magistrate’s Court on May 22, 2025.

The statement explained that the striking out of the case by the Magistrate’s Court was expected, as the State had never intended to prosecute such a high-profile matter at that level. “The accused was taken to the Magistrate’s Court on a holding charge pending the completion of investigations,” it stated.

The Ministry described the decision by the lower court as “of no consequence,” noting that the matter is now before the proper jurisdiction for prosecution.

This clarification follows mounting public criticism and media reports questioning the government’s seriousness in handling drug-related cases, especially those involving senior public officials.

Reaffirming its position, the Ministry assured the public of its “unwavering commitment to ensure accountability and justice for all crimes,” adding that due process is being followed in the ongoing case.

Njie was previously charged with multiple offences, including drug dealing, abuse of office, and theft, before the Magistrate’s Court struck out the matter due to the State’s repeated failure to proceed.

However, the Ministry now says the case is moving forward at the High Court, as investigations have progressed beyond the preliminary stage.

 The outcome of the High Court proceedings will be closely watched as a test of the government’s resolve to pursue justice in drug-related crimes, regardless of the status of the accused.
