Accused headbutts his victim to break three teeth, bags two-year imprisonment

The Kanifing Magistrate Court presided over by Magistrate Colley has fined Ebrima Sillah, an accused charged for headbutting and hitting his victim, the sum of D50,000.00 in default to serve 2-year imprisonment, and also to pay compensation of D30,000.00 and in default to serve 1 year and 6 months imprisonment.

Ebrima Sillah who appeared before the court recently, according to his charge sheet, in March 2024 at Westfield willfully and unlawfully assaulted one Momodou Jallow by headbutting and hitting him on the mouth and all over the body causing him grievous bodily harm, and thereby committed an offence.

In the narration of his offence, the incident happened on the 2nd March 2024 between the victim, Momodou Jallow, and the accused Ebrima Sillah, both drivers at Westfield Bakau garage. The victim claimed that he was provoked by the accused subsequently insulted him and stamped a bicycle that he was seated on, during the alterations the accused headbutted him in the mouth and broke three of his teeth causing him grievous bodily harm. 

Meanwhile, the accused accepted the charge, while Magistrate Colley in his ruling convicted the accused based on his plea. 

Prosecutor CPL N. Bojang sought compensation from the court under section 145 of the CPC and was granted. The accused was fined D50,000 in default to serve 2 years in prison and a compensation of D30,000 in default will serve 1 year and 6 months in prison.
