An officer from Serekunda Police Cross-Examined in Felony and Theft Case

Four accused who were charged with the offence of felony, conspiracy theft, and breaking into Supersonics Financial Services office have all pleaded not guilty to the offence on Wednesday, 17th August 2022 when they appeared before Magistrate Peter Adoh Che of the Brikama Magistrates’ Court.

The four accused, Patrick Jarju, Omar Sey, Ebrima Secka, and Lamin Chatty all residents of Sinchu Alagie Village, Kombo North in the West Coast Region pleaded not guilty to two counts of their offence.

Patrick Jarju , Omar Sey , Ebrima Sacka and Lamin Chatty were accused of stealing properties of Supersonics Financial Services amounting to D644,000 at Sinchu Alagie Village.

According to the first count of their offence Patrick Jarju , Omar Sey , Ebrima Sacka and Lamin Chatty were accused of conspiracy contrary to Section 368 of the Criminal Code Cope 10:01 , Volume 3 , Revised Laws of the Gambia 2009.

And the particular of the offence read that, Patrick Jarju , Omar Sey , Ebrima Sacka and Lamin Chatty did on the 30th August 2019 at Sinchu Alagie Village , Kombo North, West Coast Region of the Republic of the Gambia, conspired within yourselves to commit a felony with stealing, thereby committed an offence.

According to count two of their offence the four accused broke into a building committing a felony contrary to Section 283 (a) of the Criminal Code Cope 10:01, Volume 3, Revised Laws of the Gambia 2009.

According to the particular of their offence they did on the 30th August 2019 at Sinchu Alagie Village, Kombo North, West Coast Region of the Republic of the Gambia, broke into Supersonics Financial Services and stole the following:  cash amount of six hundred and nine thousand Dalasi (D609,000.00), two Laptops valued at twenty thousand dalasi (D20,000.00) and a safe valued at fifteen thousand dalasi (D15,000.00) and a  total amount of GMD644,000 ( sixty hundred and forty-four thousand dalasi)being properties of Supersonics Financial Service, thereby committed an offence.

5756 Nuha Bojang, PW1 answering to questions from Chief Inspector Allagie Kolley told the court that, the accused persons, Patrick Jarju, Omar Sey, Ebrima Secka, and Lamin Chatty were arrested on the 30th August 2019 for felony and breaking into the building of Supersonics Financial Services. He explained that he invited Sanna Ceesay as an independent witness to his office where he interrogated the 3rd accused, Ebrima Secka. He went on that he wrote the cautionary and voluntary statement and read it to the 3rd accused, Ebrima Sacka in the language he understood. But the 3rd accused Ebrima Sacka objected to the content of the cautionary and voluntary statement, noting that the content written by 5756 Bojang was different from what he narrated to him.

At this juncture, the presiding Magistrate Peter Adoh Che admitted the cautionary statement as VDES1 and the voluntary statement as VDES2 before adjourning the case to the 23rd August 2022 for continuation.
