Accused pleaded guilty of unlawful possession of Firearm without authority

Yaya Njie who was Tuesday, 14th December appeared before the Kanifing Magistrate Court presided over by Magistrate Colley has pleaded guilty of the capital offense charged against him, unlawful possession of Firearm without authority.

In narration of the matter, Prosecutor Kebbeh told the court that the incident took place   on the 11th November, 2021 at Kanifing South, where the accused entered compound of the complainant, Modou Lamin Ndow requesting for one thousand Euros.

He said when Modou Lamin Ndow was talking to calm down the accused it was then the accused brought out a pistol and asked Modou Lamin to give him his money.

He said that was the time people intervened between the accused and the complainant.

He continued in his narration that the complainant, Modou Lamin Ndow, tried and escaped to report the matter to Kairaba police station where his statement was taken and the accused was arrested and brought to Kairaba police station while his statement, too, was taken.

Moreover he said at the police station the accused confessed of committing the offense and his statement was taken too.

He said the police wrote to different army headquarters for them to examine the pistol whether it’s real or not, in their investigation they came to know that the pistol was real.
The prosecutor said that was the time the police wrote to the IGP for the matter to come before the court.

Meanwhile, the accused, Yaya Njie who had pleaded guilty of the offense further pleaded for mercy saying what he has done was a mistake that he will never repeat again. Adding that, he has spent one year in the Gambia and he is not working.

“I’m married man with three children and I am living with my mother, my wife and children and also I am the one who that is taking care of them. And I have regretted my action,” he said with soberness as he added that couldn’t sleep at night because he knows what he did was wrong.

Magistrate Colley said to the fact that the accused has pleaded guilty and he is a first time offender the court granted him bail in the sum of D50,000  in default to serve two years in prison.

According to his particulars of offense  Yaya Njie on the 11th November, 2021 at Kanifing South  was found in possession of one pistol mark Beretta gun type 54 with serial number 1901925266,with two life round ammunitions  without proper authority.  Sergeant Kebbeh represented IGP.
