UTG Case: Court Proceeds On Respondent Primary Objection

Justice L Sanneh at the High Court Annex in Mile 7, Bakau Wednesday, 22nd September, 2021 overruled objection raised by the respondent to strike the matter out during sitting of the case between the University of The Gambia (UTG) and Attorney General against the University of The Gambia Faculty and Staff Association (UTGFSA).

“I shall now proceed to rule on the respondent primary objection hearing, on the issue of non-compliance with rule number 4 in the rules of the high court which makes it mandatory that a civil matter be heard during vacation. The intending party has applied to the hearing party has applied to the judge to grant a hearing for the truth of the matter during vacation” Justice L Sanneh.

According to him, he said he’s quite agree with the respondent the applicant in the primary objection on the issue of managing the nature of the provision of order 4 rules of the high court rules.

“The question now,” he said, the provision of the law in distance case, on the expertise the first prayer is an order for live for this matter to be heard during summer vacation 2021. Though the applicants yet to move summon properly the only rules there is filled the motion on the 14th September which my lenient brother Honorable Justice Momodou SM Jallow made an injunction upon granting the applicants prayers of hearing which among others live for this matter to be heard during summer vacation of 2021” he said.

Therefore, the applicants have fully complied under the 4 rules of the high court rules. The respondent’s primary objection on the noncompliance with other 4 rules of the high court rules have failed and those are dismissed accordingly, for the issue of non –compliant 26 rules of the high court.

However, the case is adjourned until the 24th September 2021 for continuation.
