Court: Former Principal VS Education Minister

The legal wrangling involving former Principal of Model School and Minister of Education, Claudiana Cole has Wednesday 26th May, 2021 proceeded at the Brikama High Court before Justice Francis A. Achibango.

The former Model School Principal is praying for the court to make a declaration that he is the owner of the land where Model School is located at Busumbala measuring 100meters by 90meters.

The plaintiff also want the court to issue an injunction restraining minister Cole, her agents or servants from interfering with his land at Busumbala.

Presiding over the case under a tense atmosphere Justice Achibango, disclosed that it was unfortunate that the case has been protracting for so long due largely to internal issues, adding that he is now in charge of the matter and hope to deal with it judiciously.

Testifying before the court, the plaintiff, Isaac Ague told the court that the former Judge presiding over the case has accepted the striking out of his co-plaintiff and has also accepted the defendant’s amended statement.

Defense Counsel for Minister of Education, Moses Richards objected to the testimonies of the plaintiff, disclosing that the amended statement of defense has not been recorded by the court.

However, after going through the records of the court Justice Achibongo stated that there is no record available to ascertain the claims made by plaintiff, stressing that the court is anchored on the record and so far these were not filed.

He went further to advised the plaintiff to discuss with his lawyer and wife to follow the due process in withdrawing from the case, while urging the defense council to finalised the amendment of the defendants amended statement before adjournment date.

The case was subsequently, adjourned to the 21st June, 2021 for continuation of hearing on the matter.
