Man Convicted for Malicious Damage to Property

Magistrate Thomas Touray of the Kanifing Magistrates’ Court on Thursday convicted one Ousman Jagne for willfully and unlawfully damaging property belonging to his relative.

The accused pleaded guilty to a single count of “punishment for malicious injuriescontrary to Section 312 of the Criminal Code, Cap 10:01 Vol. III, Revised Laws of The Gambia 2009.

In delivering his judgment, Magistrate Touray noted that the accused did not waste the court’s time, having admitted to the facts as narrated by the prosecution. As a result, the court imposed a fine of D2,500. In default of payment, Jagne will serve six months in prison.

The complainant, Fatou Bojang, identified the convict as her grandmother’s son. She told the court that she had already forgiven him and had begun repairing the damaged items. “I have already replaced the glass doors and ceiling fan, and I will fix the television in a few days. I am not seeking any compensation from him,” she said.

According to the charge sheet presented by Prosecutor Cadet Inspector .M. Jammeh, the incident occurred on or about 28 May 2025, at Dippa Kunda, within the Kanifing Municipality. The accused was said to have willfully and unlawfully broken a Samsung 65-inch television, two glass doors, and a ceiling fan. The total value of the damaged items was not stated.

Magistrate Touray concluded the matter by urging both parties to maintain peace and avoid further conflict.
