The Kanifing Magistrates’ Court presided over by Magistrate Awa Manneh Wednesday remanded one Musa Badjan at Mile II Central Prison pending the determination of his bail conditions.
Prosecutor Sergeant E.M. Jallow, who announced his appearance on behalf of the Inspector General of Police (IGP), charged the accused with four counts of offenses: breaking into a building contrary to section 283(b), stealing contrary to section 252, stealing from a motor vehicle contrary to section 256, and wilful damage to property contrary to section 312(1) of the Criminal Code of The Gambia.
According to the prosecutor, the particulars of offense on count one alleged that on 3 January 2023, at Kotu in the Kanifing Municipality, Musa Badjan broke into a store belonging to one Modou Lamin Njie with intent to commit a felony, namely stealing.
On count two, the particulars of offense stated that on the same day and place, Musa Badjan stole two golden motor vehicle batteries valued at D4,000, one Mahmoud motor battery valued at D3,000, one X5 motor engine valued at D30,000, one ornamental E46 motor engine, and three BMW motor cylinders of unknown value, with a total amount of D37,000 being the properties of Modou Lamin Njie.
On count three, Musa Badjan was accused of stealing from three motor vehicles registration numbers BME 46, BM X5, and BJL 8694 R two radiators, four wheels, one exhaust, and additional motor wires, all valued at D575,000. These items were said to belong to Babucarr Gaye, Abdou Khadir Sillah, and Ali Njie.
On count four, Musa Badjan was accused of wilfully and unlawfully damaging the same three motor vehicles, all valued at D575,000 and belonging to the same owners.
The accused pleaded not guilty to all charges, citing that the case had previously proceeded before Magistrate Colley and had reached the defense level.
Sergeant Jallow requested an adjournment to enable him secure witnesses and objected to the bailing of the accused, arguing that he might abscond from the jurisdiction if granted bail.
Magistrate Awa Manneh, in her ruling, ordered that the accused be remanded at Mile II Central Prison pending the determination of his bail conditions and further investigation of the case file.
The matter was adjourned to 18 June 2025 at 11 a.m.
