Brikama High Court: Presiding Judge Adjourns Education Minister Vs Former Model Principal Land Ownership Case

The legal wrangling involving Minister of Education, Honorable Claudiana Cole and Isaac Ague, former Principal of Model School failed to proceed on Monday, 26th July, 2021 at the Brikama High Court due to the absence of the defense counsel, Barrister Moses Richard.

However, the former Model School Principal is praying for the court to make a declaration of being the owner of the land measuring 100meter by 90meters where Model School is located in Busumbala.

The plaintiff also wants the court to issue an injunction restraining Minister Cole, her agents or servants from interfering with his land at Busumbala.

When the case resumed before Justice Francis A. Achibango in Brikama High Court yesterday, the court’s clerk informed that he received a call from defense counsel, Moses Richards informing the court that he was feeling sick and was at the hospital to receive treatment.

The Plaintiff, Isaac Ague, argued that the presiding judge to proceed with the cases, arguing that the case has been protracting since 2015 mainly due to the absence of the defense counsel. He prayed for the case to continue with or without the appearance of the defense counsel.

However, the presiding judge, Justice Francis A. Achibango contented that the defense counsel had always been attending his courts since he took over in January of this year, adducing that the defense counsel is expected to appear in the next adjournment date with a proof of his sickness.

The matter was subsequently adjourned to the 1st November, 2021, at 10am.
