GBA Questions Qualification of Newly Appointed Chief Justice

  The Gambia Bar Association (GBA) has raised concerns over the qualification of newly appointed Chief Justice Edi M.O. Faal, saying its membership has resolved that he does not meet the constitutional requirements for appointment to the position.

In a statement issued on Thursday, the GBA said its General Membership unanimously resolved, after careful consideration, that Mr. Faal does not satisfy the qualifications prescribed under Section 139(2) of the Constitution of The Gambia.

The association said the decision was based solely on its interpretation of the constitutional provisions governing the appointment of a Chief Justice and should not be construed as questioning Mr. Faal’s integrity, competence or distinguished legal career.

“The sole issue of concern was whether the constitutional requirements for Mr. Faal’s appointment to the Office of Chief Justice had been met,” the GBA stated.

The lawyers’ body said its position was directed only at the constitutional question surrounding the appointment process and not at the personal or professional qualities of the newly appointed Chief Justice.

The GBA added that it has formally communicated its resolution to President Adama Barrow and other relevant authorities for their consideration.

Defending its intervention, the association said the appointment raises a serious constitutional matter that should be addressed before the process is concluded.

It stressed that adherence to the Constitution remains essential to safeguarding the rule of law, judicial independence and public confidence in the administration of justice.

The appointment of Mr. Faal as Chief Justice has attracted public attention, with the GBA’s position calling for further consideration of the constitutional requirements governing the office.
