Court Orders Tenant to Settle D50,000 Rent Arrears Within Eight Months

By: Isatou Sarr

The Brikama Magistrates’ Court has ordered a tenant to pay D50,000 in outstanding rent to his landlord within eight months, following a civil suit over unpaid dues.

Magistrate Kanjura B. Sambou delivered the ruling in a case involving Abdoulie Jallow, the plaintiff, and Buba Jallow, the defendant, after the latter admitted owing the principal sum claimed.

Court records indicate that the plaintiff sought the recovery of D50,500 in rent arrears, along with D3,000 as damages for breach of contract and any further relief the court deemed appropriate. The claim stemmed from allegations that the defendant, a tenant in the plaintiff’s compound, had defaulted on rent payments for a period of one year despite repeated demands.

When the matter was called, both parties appeared in court without legal representation. The statement and particulars of claim were read aloud to the defendant in open court.

In response, Buba Jallow accepted liability for D50,000 of the amount claimed but denied responsibility for the additional damages sought by the plaintiff.

In her ruling, Magistrate Sambou entered judgment in favour of the plaintiff based on the defendant’s admission. The court awarded D50,000 as the agreed outstanding rent, along with D1,500 in costs.

The court further directed that the total sum be paid within eight months from the date of the judgment.

The ruling brings the matter to a close, unless issues arise regarding compliance with the court’s payment order.
