Court Adopts Consent Terms as Judgment in a Case between BSIC and Konnect Oil

Justice Sonia of the Banjul High Court Annex on Tuesday adopted consent terms reached by the parties as the judgment of the court in a civil matter between Banque Sahelo-Saharienne Pour l’Investissement et le Commerce Gambia Limited (BSIC) and Konnect Oil (Gambia) Limited, together with Mahammed Camara.

BSIC was the applicant in the case, while Konnect Oil (Gambia) Limited was the first respondent and Mahammed Camara the second respondent.

Through an originating summons, the applicant sought several reliefs, including a declaration that the first respondent owed the bank the sum of D2,558,398.61.

The bank also asked the court to grant an order for the judicial sale of property belonging to the second respondent, held under a deed of assignment bearing Serial Registration No. 694/2024 KD, situated at Manjai Kunda and comprised in Leased Serial Registration No. K49/2000.

The applicant further sought an order directing the Sheriff to conduct a judicial sale of the property of the first respondent covered by a Memorandum of Deposit bearing Serial Registration No. 661/2024 MD. The bank also requested that the proceeds of the sale be used to settle the debt of D2,558,398.61, with interest at 22 percent per annum from 5 November 2025 until the date of judgment.

In addition, the applicant asked the court to order that the respondents be held jointly and severally liable for any balance that may remain unpaid after the sale of the property, as well as legal and administrative expenses amounting to D76,751.95, and any further order the court may deem fit.

During the proceedings, the parties explored the possibility of settlement and subsequently reached an agreement.

The terms of the agreement were reduced into writing and presented before the court as consent terms.

According to the consent terms, the second respondent admitted that, as of the date of signing the agreement, the first respondent owed the plaintiff D2,815,718.45, an amount inclusive of interest. The second respondent, acting as guarantor, also admitted liability for the same sum.

The agreement further stated that the second respondent would settle the debt through equal monthly instalments of D78,214.40. It also provided that if there is any default in the agreed monthly payments, the entire outstanding balance of the judgment debt would become immediately payable.

The consent terms also empower the Sheriff of The Gambia to conduct a judicial sale of the property used as collateral, located in Manjai Kunda and comprised in Lease Serial Registration No. K49/2000, contained in the deed of assignment bearing Serial Registration No. 694/2024 KD. Proceeds from the sale will be used to settle any outstanding amount on the judgment debt.

Both parties subsequently applied for the consent terms to be adopted as the judgment of the court.

Delivering her ruling, Justice Sonia states that the consent terms dated 25 February 2026 are hereby adopted as the judgment of the court.
