Two men, Modou Jallow and Ba-Nuha Darboe, appeared on Monday, 29th September, before Magistrate I. O. Njie of the Brikama Magistrates’ Court on three counts ranging from conspiracy to commit a felony to housebreaking and stealing.
Sergeant 4422 M. J. Sallah represented the Inspector General of Police, while the accused were unrepresented.
On the first count, the two are charged with conspiracy to commit a felony contrary to Section 341 of the Criminal Offences Act. The prosecution alleged that on or about 17th September 2025, at Gunjur, Kombo South, West Coast Region, the two conspired to commit a felony, namely breaking and stealing.
On the second count, they were charged with housebreaking contrary to Section 256 (1)(a) of the Criminal Offences Act. It was alleged that on the same date and place, they jointly broke into the house of Ousman Darboe and committed a felony therein.
On the third count, the accused were charged with stealing contrary to Section 226 of the Act. The prosecution alleged that they stole a bag containing D500 in cash, a bracelet valued at D1,100, two pairs of shoes valued at D2,500, D2,000 in cash, five packets of cigarettes worth D750, a Bluetooth speaker valued at D700, and a torchlight worth D800, all properties of Ousman Darboe, amounting to a total value of D8,950.
The charge sheet was read and interpreted for the accused persons, who both pleaded not guilty.
Prosecutor Sallah applied for an adjournment to secure witnesses and objected to bail for the accused. He argued that one of the accused had previously been granted bail by the same court, reoffended after release, and was now before the court again for a similar offence. He further submitted that granting bail would likely result in the accused committing further offences, citing information from Gunjur Police Station describing them as “a nightmare” when in society.
The case was adjourned to 14th October 2025 for the testimony of Prosecution Witness 1 (PW1). The issue of bail will also be determined on the next adjourned date.
