Four individuals, Kemo Fatty, Alieu Bah, Momodou Camara, and Omar Saibou Camara, appeared before Magistrate Sallah Mbye at the Kanifing Magistrates’ Court on Wednesday, 17th September 2025, facing charges of unlawful assembly and common nuisance following a protest at the National Audit Office on Monday, 15th September 2025.
Commissioner A. Sanneh and ASP Y.S. Colley, who had represented the IGP in the matter, alleged that on 15th September 2025, the accused held a protest without a permit from the Inspector General of Police (IGP), opposing the controversial removal of the Auditor General, Mr. Momodou Ceesay.
According to the charge sheet, the accused “conducted themselves in a manner likely to cause a breach of the peace,” and caused “annoyance, obstruction, or inconvenience to the public” in the area. All four pleaded not guilty to the charges.
Commissioner Sanneh objected to their bail, proposing that any bail condition must bar the accused from engaging in further protests without a permit.
However, defense counsel J. Darboe argued that setting bail conditions is solely within the discretion of the court.
Magistrate Sallah Mbye upheld the defense argument, stating clearly that bail and its conditions are the court’s prerogative, not the prosecution’s.
The court granted each accused bail in the sum of D50,000, with one Gambian surety who must provide an affidavit of means. The accused are required to attend all hearings until the case is concluded.
The matter was adjourned to 21st September 2025 for hearing.
