The Kanifing Magistrate Court presided over by Magistrate B. Sowe on Tuesday convicted and sentenced Ebrima Touray to pay a total sum of D273,328 for careless driving.
This followed a road traffic incident that occurred on 24 August 2024 at Kairaba Avenue Touray, was charged with driving a vehicle without due care and attention pleaded not guilty.
The prosecution proceeded to open its case and called three witnesses to testify including the complainant, Samuel Joshua.
Joshua, in his testimony, told the court that on the night of the incident, he was inside a Suzuki Vitara belonging to his sister. He explained to the court that while they were traveling from Fajara towards Banjul and approaching the round -about of Kairaba Avenue Flyover, the accused Tourary stuck their vehicle.
Magistrate Sowe noted that both Josuha and another witness Thomas Ebrima Coker, expressed ‘’fear and terror’’ as a result of the reckless behavior. She described Tourary’s conduct as dangerous and falling below what is expected of a careful driver
In delivering the verdict Magistrate Sowe found Tourary guilty under sections 145 of the Criminal Procedure Code and section 51(1) of the Motor Traffic Act, Cap 70: 03 Revised Laws of The Gambia ,2009.
The court ordered Tourary to pay D272,328 in compensation to the complainant and an additional D1000 fine.
Failure to pay the full amount will result in a mandatory one-year imprisonment at Mile Two Central Prison
