Magistrate Warns Police to Produce Facts or Abuko Drifting Case Will Be Struck Out

Magistrate Dibba of the Kanifing Magistrates’ Court Thursday warned police prosecutors handling the Abuko School drifting incident that the case will be struck out if they fail to present the facts at the next hearing.

The case, which involves a student injured in a reported car drifting incident at Abuko, was yesterday adjourned for the prosecution to file the victim’s medical report and present facts supporting the charge.

During the brief hearing yesterday, the police prosecutor informed the court that the victim was in a serious condition and “bleeding too much”, and argued that was why they could not yet provide the full facts.

Magistrate Dibba told the prosecution that the severity of the victim’s condition should not prevent them from obtaining a medical report from the hospital. “No matter how serious it is, if a request is made to the hospital, they would grant it,” Magistrate Dibba said.

The prosecutor requested more time, insisting that the victim’s condition was critical and that had delayed the investigation.

However, Magistrate Dibba cautioned that the police should have completed their investigations before bringing the matter to court. “I will only give you this last chance. At the next hearing, if you are unable to bring your facts before the court, I will discharge the accused,” the magistrate warned.

The court granted the prosecution’s request for an adjournment but made it clear that failure to present the required evidence at the next sitting will lead to the case being struck out.

The case has been adjourned to 14 August 2025 at 11:30am for continuation of the trial.
